Terms of Service

1. Acceptance of Terms

By accessing or using The Swamp ecosystem ("Service"), including the game, SwampX token launchpad, and any related applications, you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, users, and others who access or use the Service.

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not located in a jurisdiction where cryptocurrency or token trading is prohibited
• You are not on any sanctions list or prohibited from using financial services

3. Description of Service

The Swamp provides:

• Gaming Services: A multiplayer game with fishing, collecting, and competitive features
• SwampX Launchpad: A decentralized platform for creating and trading tokens on the Solana blockchain
• Wallet Services: Non-custodial wallet creation and management
• Rewards System: In-game rewards and XP system

4. SwampX Token Launchpad - Important Disclaimers

By using SwampX, you acknowledge and agree that:

• Not Financial Advice: Nothing on this platform constitutes financial, investment, legal, or tax advice. Always do your own research (DYOR).
• No Endorsement: The Swamp does NOT endorse, verify, or guarantee any tokens created on SwampX. Token creators are solely responsible for their tokens.
• Decentralized Nature: SwampX is a decentralized platform. Once tokens are created, The Swamp has no control over them.
• Risk of Loss: Tokens may lose all value. Many tokens fail. Only invest what you can afford to lose completely.
• No Refunds: All transactions on the blockchain are final and irreversible. There are no refunds.
• Not Securities: Tokens created on SwampX are intended to be utility tokens, not securities. Users must comply with their local laws.
• Smart Contract Risk: Smart contracts may contain bugs or vulnerabilities. Use at your own risk.

5. User Responsibilities

You agree to:

• Comply with all applicable laws and regulations in your jurisdiction
• Not use the Service for any illegal purposes, including money laundering or fraud
• Not create tokens that infringe on intellectual property rights
• Not engage in market manipulation, pump and dump schemes, or other fraudulent activities
• Secure your wallet credentials and private keys
• Accept full responsibility for your trading decisions

6. Wallet Services

The Swamp provides non-custodial wallet services. This means:

• You are the sole owner of your private keys
• We do not store or have access to your private keys
• If you lose your keys, we cannot recover your funds
• You are solely responsible for the security of your wallet

7. Fees

The Service may charge fees for certain transactions:

• SwampX Trading Fee: 1% on trades (competitive, transparent)
• Network Fees: Solana blockchain transaction fees (paid to the network)
• Graduation Fee: Fee applied when tokens graduate to DEX

Fees are subject to change with notice.

8. Intellectual Property

The Swamp and its original content, features, and functionality are owned by The Swamp and are protected by international copyright, trademark, and other intellectual property laws.

Users who create tokens retain rights to their own branding and content, but grant The Swamp a license to display such content on the platform.

9. Limitation of Liability

This includes but is not limited to:

• Loss of funds due to smart contract bugs or exploits
• Loss of funds due to user error or compromised credentials
• Loss of value in tokens you create or purchase
• Actions of other users or token creators
• Network issues, blockchain congestion, or technical failures

10. Indemnification

You agree to indemnify and hold harmless The Swamp, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We reserve the right to terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page with an updated date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
